The court transcript, as with most of these types of cases, is full of precedent examples. Unless the Council succesfully appeal this then the result will be a precedent example for future claims.

I reckon this little decision will not only kill off that riding area but also any chance of new offroad areas which are needed - Council insurers will refuse to cover them out of fear that someone will go blindly blazing their way around, hurt themselves and successfully sue.

I'm of the view that if you fuck up then you live with the consequences, but can kind of understand why this bloke went to court when a dodgy legal firm says we'll get you $500,000. Unfortunately he has a big personal win and the rest of us lose through higher Council rates to cover increased insurance costs and being told we can do fewer and fewer things in public areas.

the only hope of an appeal rests with the Shire of Gingins insurance company. It is purely an economic decision for them and has nothing to do with what will ultimately be good for the community.
