He had never ridden on the dunes before. He was riding an XR400 which he described to the Court as a "farm bike"
The Shire was not doing any works or anything to the dunes at the time he crashed. There was, however, a Police and Ambulance contingent at the bottom of the said dune where he crashed because of an earlier crash where another rider died.
The shape and constitution of the dunes changes daily due to wind and vehicle traffic. No two dunes will be the same and no dune will be the same tomorrow as it is today.
From what I read in the decision, he received neck, head and leg injuries. I do not know whether he has any lasting injuries.

Some time ago, ma and pa were in a boating accident precipitated by a very large, sudden wave in a notorious little reef passage near Coral Bay.
Mum got broken wrist and ankles for her troubles, fairly expensive etc - the only way the bills were getting paid was if she sued the old man (who had public liability insurance with the boat policy). Shit to have to go that way but there you go.
Could quite possibly be a similar thing - who has the insurance? The council. Go get 'em, nice payout, easy peasy.

Had a friend die up there (RIP Jamie) when we were in high school (18 years ago) and his parents didn't sue anyone looking to pass on the blame.
Someone mentioned in a previous post that they sue to help cover medical costs.... as harsh as it sounds, the Judge should have sent him on his way empty handed.
There has been huge debate on radio today, as one caller said whats next? Shut down all the skate parks, hang gliding cliffs etc? FFS peoples, when you pull on your helmet (those of us who choose to) it's a pretty damn straight forward assumption that your gonna end up on your head sooner or later (in the dirt) You have to take responsibility for your own actions.
A citing lap is usually the best way to go about things, not screaming over the edge of every dune face and hoping it's all good on the other side!
I've ridden at Lancelin for more years than I can remember, and will continue to ride there regardless of any outcomes from this crap.

If the Shire appeal and wins, it's still all over, as the risk of being sued again would still be real.
The idea of having the State take it over is the only option, and I can't imagine this Government (the fun Police) putting themselves in the situation to left open to liability suits so a bunch of hoons can have some fun.
I've had a lot of fun in the dunes up Lancelin and it's a tragedy that future generations won't have access to it.

Who do we sue when we run into the signs? Due to the slow privatisation of health and lack of Government/Community support after some one is injured, people are now being forced to sue. The Federal Govmint is capable of sorting this sort of crap out. Whens the next election? Talk to your local member (no not the one between your legs the other dick) and express your self to the overpaid disinterested representatives.

We get ass raped for no helmet and such on the roads, how about bringing in a $1,000 fine for not wearing a helmet in the dirt?
