Do we have the full story? If he went over a sand dune and the council had decided to refurbish the other side with a big fence, then I'd be a little upset they hadn't pointed out that they were fixing up the dunes I'd ridden on since I was 8 too.

What sort of physical injuries did this dick get? Permanent? If he has permanent injuries like spinal..perhaps this was his only option? I dunno...was just thinking out loud.

He had never ridden on the dunes before. He was riding an XR400 which he described to the Court as a "farm bike"

The Shire was not doing any works or anything to the dunes at the time he crashed. There was, however, a Police and Ambulance contingent at the bottom of the said dune where he crashed because of an earlier crash where another rider died.

The shape and constitution of the dunes changes daily due to wind and vehicle traffic. No two dunes will be the same and no dune will be the same tomorrow as it is today.

From what I read in the decision, he received neck, head and leg injuries. I do not know whether he has any lasting injuries.

Good point, FG (much though it may pain me to admit it)...

Some time ago, ma and pa were in a boating accident precipitated by a very large, sudden wave in a notorious little reef passage near Coral Bay.

Mum got broken wrist and ankles for her troubles, fairly expensive etc - the only way the bills were getting paid was if she sued the old man (who had public liability insurance with the boat policy). Shit to have to go that way but there you go.

Could quite possibly be a similar thing - who has the insurance? The council. Go get 'em, nice payout, easy peasy.

Sadly, though, the council's premiums now skyrocket unless they do something a little more constructive to manage the risk than erecting a few signs...

Thank goodness for private sand dune regions...

    I am dumbfounded!

What is this place coming to?

I heard there is 3 more cases pending against the shire of Gin Gin regarding surfer and wind surfer accidents? WTF? I know, lets shut down the beach! Knobs!

Had a friend die up there (RIP Jamie) when we were in high school (18 years ago) and his parents didn't sue anyone looking to pass on the blame.

Someone mentioned in a previous post that they sue to help cover medical costs.... as harsh as it sounds, the Judge should have sent him on his way empty handed.

There has been huge debate on radio today, as one caller said whats next? Shut down all the skate parks, hang gliding cliffs etc? FFS peoples, when you pull on your helmet (those of us who choose to) it's a pretty damn straight forward assumption that your gonna end up on your head sooner or later (in the dirt) You have to take responsibility for your own actions.
A citing lap is usually the best way to go about things, not screaming over the edge of every dune face and hoping it's all good on the other side!

I've ridden at Lancelin for more years than I can remember, and will continue to ride there regardless of any outcomes from this crap.

Left the Ranger for dead heaps of times up there!

As the song goes......for the times, they are a changing!

On a side note, what are they gonna do about Wedge?

It's fucked. Next thing you know, wheelies and burnouts will be illegal even though they're comparatively safe.

If the Shire appeal and wins, it's still all over, as the risk of being sued again would still be real.

The idea of having the State take it over is the only option, and I can't imagine this Government (the fun Police) putting themselves in the situation to left open to liability suits so a bunch of hoons can have some fun.

I've had a lot of fun in the dunes up Lancelin and it's a tragedy that future generations won't have access to it.

    Only option?

    You always have options.

I'm sure saf would have plenty to say about this clown's options.

Who do we sue when we run into the signs? Due to the slow privatisation of health and lack of Government/Community support after some one is injured, people are now being forced to sue. The Federal Govmint is capable of sorting this sort of crap out. Whens the next election? Talk to your local member (no not the one between your legs the other dick) and express your self to the overpaid disinterested representatives.

Hhahaha love it, and there should be more people like you and i.

    May i tell you ?

THIS STATE IS ROOTED. If it were a car, it would be a rusted out Jag, even tho once it had some dignity in the 70's .... its now a rusty pile of shit because everyone used and abused it for so long, and now its beyond repair.

    Ausfailia.

There ya go people , start looking and post up any that became defensive when you mention Lancelin.

" (d) failed to take any or any adequate steps to barricade off and prevent riders/drivers of off road vehicles to jump off the sand hill that the Plaintiff jumped from;"

Bahahahaha... What's the bet that they close the main carpark entry, and everyone is still out there?? Fuck, I know about 5 ways in.

Any lawyer that puts that down as a legal arguement, should be dis-bared.

Things like this should go to a pre-trial, at what point a panel of sensible people should say "Your serious ? ..... no reaally, ARE_U_SERIOUS ?" . And cancel the right to dribble this crap.

Least the Judge called him a fool.
    Para 153.
Reckon the liability percentage should be the other way around. Cos signage is a bit crap up there.
Heck, just fill the 'driveway' with soft sand. Least then you have to have *some* clue to get in.

This was also on 9 News, was a fairly large segment too because they're concerned about the ramifications this ruling could have for recreation facilities generally.

It is my understanding that the Shire's insurance company is still undecided as to whether they will appeal the decision.

    Another one bites the dust.....

It was just on the news that a 20 yo man and his female passenger went C.Up on their quad at Lancelin today...... He can't feel his legs, she was knocked unconscious.

The worst part about it was that the final footage was from a chopper showing a squid on a Yamaha Raptor with no helmet on, shorts and tanktop carving it up in the dunes........ TWAT!

We get ass raped for no helmet and such on the roads, how about bringing in a $1,000 fine for not wearing a helmet in the dirt?

Does that Big Foot Bus still run up there?
Can't imagine they'd do a roaring trade driving up and down the main street in Lancelin over summer...
