    Are dealerships allowed to sell "encumbered" bikes - ie bikes that still have finance owing on them ?

    If not - what is the best course of action if you have purchased a bike from a dealer - only to find it has finance owing on it when it is time to sell ??

    dealers, as far as i am aware, are not allowed to sell encumbered vehicles- go back and kick up a stink about it

    This happened to my sister many years ago with a car...

    We went and *persuaded* the car yard to hand over another car and gave them the one that was being repo'ed back..

    It was there problem not ours...

    Go back to the shop and claim yourself anothern bike or money back...

    Failing that get a lawyer and give them a world of hurt...

    Just reread your post...you have had this bike for some time assume...

    Thats a little weird...but still the dealer sold you an encumbered vechile...

    But is it illegal or just a guideline ??

    it's a law, dealers especially have a responsibility to do a revs check.

    Have you checked with the finance company to see if there actually is still money owing? I work for a credit union and we get quite a few people calling who have bought and are now trying to sell vehicles that previously had our finance but for whatever reason the revs had not been removed even if the loan was paid out.

    now that is the reason why i buy from dealers, its THERE problem to make sure it has a clear title


    before you go and rip them another anus double check it is the case and just talk to them politely about it, i would imagine with this sort of thing they would rather it dealt with the mininum of fuss and view from the public eye

    yeah what falcore said, the dealer should sort it out pretty quickly for you with a minumum of fuss.

    Basically if the bikes still encumbered from previous finance then technically isnt it actually the finance companies property anyway?

    Id be screaming blue bloody murder if I bought an encumbered bike and then someone tried to repossess it.
