    Lane Splitting Penalty?

    Hi all,
    I am aware that lane filtering ( Cars Stationary ) is legal but that lane splitting ( freeway at speed ) is not, does anyone know what the penalty that can be inforced is, i.e. demerits and money?

    No penalty because it's not illegal on a dual carriageway. Changing lanes without indicating is though.

    It depends on the mood of the police person who pulled you over.

    Can range from a stern talking to, to "crossing a solid white line", "failing to indicate", "entering a controlled intersection" (this one can possibly be argued against with semantics unless they've changed the law in the last few years) or "Dangerous/Reckless Drivings" (usually splitting too fast).

    All but the last one can be avoided if you indicate and don't cross any lines you shouldn't be, but if they feel like doing you for dangerous, it's probably up to you to argue against in court.

    I've been stopped once for splitting (and other stuff) in 30 years and didn't get booked. If you split at speed you are asking for a ticket and death.

    As an aside, when I split I don't indicate and avoid weaving as it seems to make drivers nervous and piss them off. On Tuesday morning a watched a guy on VTR250 with a loud pipe splitting, going much faster than cars were moving and indicating constantly while weaving from lane to lane. Drivers were reacting as he went by.

    What is the view - smooth down the middle, or indicate and weave?

    I stopped and was fined $150.
    Not breaking the law doesn't stop them handing out fines.

    Straight down the middle, avoiding cat eyes where possible, and avoiding stopping on the unbroken white line in wet weather.

    Indicating and weaving seems to make people nervous and they can react pretty unpredictably, I don't want to be involved in a crash or cause one because a car breaks suddenly thinking I'm merging into them.

    I try to avoid weaving unless there's people pretty much on the line and I need to swap sides to go past, then its mirrors/headcheck and move the few inches over the line I need. Probably illegal, but in my opinion safer.

    Not sure about the fine's, never been caught, but 200kph straight up the middle is the only way to do it! Look out for hyundai drivers though

    They would have been reacting to something loud and 'fast' (relative to a slow moving car), not his indicating and weaving. A lane change doesn't have to be a pronounced 'weave'. You're only moving about 30cm to get to the other side of the line. I 'weave' constantly (when it is necessary obviously, not for the hell of it), and indicate when required, but I am not abnoxious with my speed, threatening and try to be as expected as possible for the peeps in the cars.

    Split past the popo every day with no problem, not much chance they could catch a bike in traffic anyway. The main thing is I only go 15-20ks faster than the traffic so if someone changes lane they may have some chance of seeing me coming and I can easily stop in a hurry if they dont.
    In my experience the pigs have only hassled me when I have been riding like an arsehole and have collared me for my own good.
