    Motorcycle Mudguards - the 45 degree rule

    The relevant ADR is 42/04 which provides as follows:
    14.3 Wheel Guards for L-Group Vehicles (including motorcycles)
    14.3.1 Wheel guards may consist of either permanent body structure or part structure and other components, including mudflaps, provided the specified protection is retained during vehicle operation.
    14.3.2 General Requirements
    The wheels of a vehicle and the wheel of a side-car must be fitted with wheel guards of width not less than the ‘Section Width’ of the tyre. The wheel guards must be so designed as to protect other road users, as far as practicable, against thrown-up stones, mud, ice, snow and water and to reduce for those users the dangers due to contact with the moving wheels.
    14.3.3 Special Requirements
    14.3.3.1 Rear ‘Axle’ and Side-car
    The wheel guard provided for the rear wheel and for the wheel of any side-car must extend not less than from a point vertically above the foremost part of the wheel rearward to a point not higher than the intersection of the arc of the wheel guard with a line through the centre of the wheel at 45 degrees to a horizontal plane through the centre of the wheel when a mass of 45 kg is distributed in the saddle of the vehicle at its ‘Unladen Mass’.

    So SURPRISE SURPRISE YOU NEED TO BE SITTING ON YOUR VEHICLE WHEN THEY PERFORM THE MEASUREMENT AND


    This /04 version was first approved as a national standard on 9 December 2003 in Road Vehicle (National Standards) Determination No. 5 of 2003. The determination was published in the Commonwealth of Australia Gazette No. S 482 of 18 December 2003.

    So if your vehicle was made BEFORE 18 DECEMBER 2003, they can fuck off because prior to that it simply stated The wheel guards must be so designed as to protect other road users, as far as practicable, against thrown-up stones, mud, ice, snow and water and to reduce for those users the dangers due to contact with the moving wheels. There was no 45 degree requirement

    So, if a cop pulls me over tells me to get of the bike and says to me that he'll be giving me a sticker for the rear mudguard because its not 45 degrees, I have to inform him about this or does this make his sticker void? =/

    inform him that ADR42/04 specifies that you are to be sitting on the bike to ascertain whether the guard cuts a point not higher than than the intersection of the arc of the wheel guard with a line through the centre of the wheel at 45 degrees to a horizontal plane through the centre of the wheel

    Was there another law pre-exiting beofre 1997? Would older bikes have to meet this law?

    Cheers for that Simon. Still the law is a bit silly. If I at 70Kg sit on my bike the rear is on going to squat as much as if someone weighing 110KG sat on it. Therefore the angle would be different. So because I'm lighter I could get pinged where as a heavier bloke wouldn't....

    Also As someone posted up in another thread, what is it is a completely stock bike and it doesn't meet the 45deg rule? It must have past the ADRs to get here so is there a differeing rule between stock and after market?

    where'd you get that info?

    also i wonder if this was brand new in Dec 2003, or was there a similar rule in place prior to Dec 2003, and the Dec 2003 thing was just a revision or a small change to it? just playing devil's advocate ...
