    Wheel Clamping City West

    Need some help related to appealing a wheel clamping fee.

    My wifes car was clamped today at city west. Its allegaed on the tax invoice she arrived at 10:30 am and the clamp was put on at 12:50pm.

    The wife was at Chiro appointment in Dianella at 10:00 to 10:30am and hasd a Eftpos Reciept with the time stamp of 10:24am on it. She then drove to her work in West Leederville to tidy at some stuff then drove and parked at City west at 11:30.

    The chump wheel clamper obviously doesnt know how to read a watch and has confused 10 for 11.

    My wife tried to explain the impossibilty of her being in 2 places at once to which the bloke become aggressive, she then paid the fee to remove the clamp for the following reasons:

    She did not want the situation to escalate,
    She needed the car for the rest of the day,
    and she thought she had a pretty air tight appeal case of how she couldnt have been parked at city west at the alleged time.

    I gave the clamping company a call, they were not interested in our side of the story. Flat out called myself and the wife liers then hung up on me.

    Im at a loss at who i can turn to now as these wheel clamping companies seem to be totally unregulated.

    Any thoughts on a way forward? best to see a laywer?

    How much money do you wish to throw at it? Legal aid, if on the cheap I'm guessing?

    If you have proof of where and when you were around (with an alibi) then it will be pretty open and closed...
    Just remember, the council operates on a "'we are right" "you are wrong"' mentality.

    scammed - they know the times - but rip ya off anyway - after all whats your mrs' gonna do - or anyones mrs for that matter - pay up - cause ya want ya car back - & they know it - lesson learnt i reckon - i dont ever park any where clamp signs are up - for that very reason

    Its not even the money, the fact the cunts called myself and the wife liers. The companies telephonist even called me back after she hung up on me to once again dispute my version of events and hung up on me a 2nd time.

    Its a private clamping company on privately owned land so no councils should be involved.

    I only suggested a lawyer since i have no idea on who else there isto approach. Other industries have Ombudsmen or associations you can go to with grievences, these guys seem like cowboys that are allowed to do what ever they want with no come back.

    I asked for some evidence of the car being there at 10:30am, they would not supply me with photos, or the on site clampers manifest where he records regos and times against the associated car. The telephonist also wouldnt provide me with a managers name or number so i could speak with them on monday.

    A stern letter with the facts listed in chronological order to the "Company" in question, will usually yield results... Albeit you have to pay for your car to get out now (They have you at ransom) - I thought City West was under Council control?

    Anyhow I suggest you play nice with them and document everything!

    If no joy, then there are other avenues here to pursue re-compence.

    I had a similar issue there a little while back. The guy with the keys to the clamp is a lowlife scumbag. I tried getting in touch with the company, who after waiting a week from receiving my version of events sent me a generic "Thankyou, but we've investigated it and it's valid" email.

    Lesson learnt, will never go back there again.

    $130 poorer for the experience, but not a lot you can do about it. Mine was with the bike, which I did consider just coming back with a trailer to remove the bike, in hindsight it's what I should have done.

    Better off finding who the clamping company is working for (carpark owner/operator) and complain to them as they've engaged Western Parking to be their enforcers.

    Should park a bait car there everyday to collect clamps then Every night when there not around come back and grind it off with a battery powered 9 inch, each day there's a new clamp destroye, surely that's gotta hurt them

    Haha, this the continuation of the Citywest saga. Same big dudes, intimidation is their tactic.

    I was in the right, they were wrong and it took a mexican stand off to have them remove the clamp at no cost. I was prepared to come to blows on this at the time.

    It is unfortunate that two big dudes need to feel good about themselves intimidating women, I wonder what they tell their kids they do for a living?

    imo - if your really pissed, don't go to the clampers, or lawyers, its pointless. first thing Monday morning take it up with whoever has employed them, which is probably centre management, vent all your anger on that person, explain how their employee behaved, how they rang you back and their behavior after the clamping.

    give them both barrels, reload and go again

    It's a pity we can't find a spare wheel clamp somewhere & clamp their vehicle whilst they are doing someone else.... Leave their own note on the car to contact their company and see how THEY go trying to get it off!

    Best approach is to go to the media. Send an email to Howard Sattler at 6PR - that's the kind of thing he'd be all over. Because you paid the fee you have no legal recompense through the courts.

    The other avenue may be DOCEP - they investigate complaints about businesses that operate illegally

    Did your wife shop only at City West or did she go across to Harbour Town and leave her car in the free parking?

    IIRC, there are signs there indicating parking is only for shoppers at City West. If you leave their premises and shop somewhere else, they clamp you.

    If your wife only did shopping at City West and was parked for less than 2 hours, write a letter to these people:

    Just like any private residence, City West hire the clampers to monitor their car park. However, if you have been clamped incorrectly, they can also arrange a refund for you.

    Actually that's a great idea. If they know that the p[eople they hire are being cowboys and turning people off coming to City West they won't be happy. And then if you don't get satisfaction go to the media - the last thing they'll want is bad publicity
