Mobile phone = bad. Even just to look at (bad luck, Spock, btw).
but 2-way = okay.
and gps/tomtom etc = okay.

What I'd be interested in finding out whether I'm being naughty for using my GPS on the bike, even though the GPS happens to be running on a mobile handset.

Not interested enough to get pineappled for, but interested.

To be honest i generally dont look at what car drivers are doing whilst riding whether they be eating pies drinking piss or chatting on the mobiles. im enjoying the ride too much. I really couldnt be fukked tooting someone for fear they shit themselves and turned into me its not like im driving around wrapped in steel like they are.

Infuriates me in ways I can't even begin to express.

I know what I'm doing over these holidays. I can't hold a conversation in the car without crashing, so I'll just get pissed to pass the long journey time then.

Now some of you may disagree - but this is bullshit. Why is it okay to take my glove off, unzip my jacket sleeve and roll it up to see the time on my watch but not to glance at the time on my phone? Alternatively I could keep a pocket watch on me and pull that out to see the time and I'd be A-OK legally.

For that matter, in cars, why is it okay to adjust your radio, light a cigarette, eat a sandwich, talk to your kids in the back seat etc, but now we are told it should be a gaol-able offence to pick up your phone and look at it?

As the good Captain said, some people need to get some perspective - and the police need to concern themselves with enforcing the SPIRIT of the Law and not the LETTER of the Law.
I would say they are just being wankers as having a mobile in your hand is not "using it" . If that was the case then they could give tickets to all unlicenced persons sitting in a parked car

265 . Use of hand-held mobile phones
(1) On or after 1 July 2001, a driver shall not drive a motor vehicle and use a hand-held mobile phone while the vehicle is moving, or is stationary but not parked.
Points: 1 Modified penalty: 2 PU
(2) In this regulation —
"mobile phone" does not include a CB radio or any other two-way radio.

I can't form a solid opinion on mobile phones. On the one hand they could be distracting. On the other hand, not by much. Singing along to the radio is probably more distracting in some ways, perhaps we should ban FM radios.

I would like to see some stats as to how many accidents are caused by a driver who was using a mobile. They probably don't exist as it would require everyone to be perfectly honest to the cops. But I would guess that it would be less than the number of accidents caused by people losing control of the vehicle due to innapropriate speed for the conditions, just imagine the response on PSB if someone posted speeders should get jail time.

Also, they should start making cars only big enough for one person. Having a conversation with your passenger could distract you. And windows shouldn't be able to be wound down. Wind might distract you. And if it rains? Automatic driving-ban in place immediately, all cars must be stopped where they are and must not start moving again until the road is dry.

Simple solutions. Really.
Particularly the having a conversation with others in the car thing rings true to rumours of banning even handsfree mobile phone conversations because they're a distraction.

However as a general rule, I've found other road users to be a distraction too. Maybe a one car per road limit.

Edit: Jedi- I remember reading about one woman in the US of A who couldn't really deny it. She rolled her van. In the roll she severed part of her arm. They found the section of her arm/hand still holding the mobile phone. I wish that was a joke.

Far worse IMHO.

The difference is, DUI often happens when you're not in a sane state of mind.

Mobile phone use when you're totally sober and consciously making the decision to do it - when even hands-free mobile use has been found to be just as dangerous as driving at 0.08 in various studies... is inexcusable.

someone mentioned the GPS issue.

I think these are as bad if not worse than using a mobile phone.

I'm sure the only reason they aren't banned is because the laws have not caught up with technology. As per usual, they will wait until a few people are killed by people looking at their GPS before they introduce laws restricting their use.

What really shits me, and being a daily commuting bike rider I see it all the time, are the people who have to look at their passengers whilst talking to them and occasionally glance at the road-FFS you aren't going to crash into your passenger so why spend so much time looking at them?

The issue is that when the user is attempting to hold a conversation with the other end, they are visualising the person, concepts to discuss, etc and their mind is totally off in the wilderness.

This is why its so much worse than operating your radio (simple stuff at least, like volume or switching to preset channel, etc), a GPS (glance to see where you are going), etc.
