Sounds like its too tight
did you check the freeplay AFTER you tightened the rear axle?

Turn your wheel and check you chain tension at different spots in the chain...

What Rich and Hewie said about seized links or areas of chain is a good start.
Also check to make sure your rear wheel is straight in the swingarm. If you wound up one side's chain adjuster more than the other, the wheel (and sprocket) might be out of alignment and start causing weird noises.
There should be some sort of marks on or near the adjusters. Make sure they're the same on both sides.

i reckon loosen everything off and start again

make sure you align the rear axle so the rear sprocket is nice and straight.. did you use the big screw driver in the rear sprocket to keep everything tight and straight while you do up the axle nut?

also i thought you normally want about 25mm vertical play not 40mm?

Yeah, sometimes the markings are pretty poor. If you have access to a set, grab some vernier calipers and measure off a set reference point on each side, to make sure they're the same. I use them to make sure I get the rear axle as close to aligned as possible.

i set 25mm unloaded on the side stand

umm how to explain, when you do the axle nut up nice and tight it can shift the axle position away from where you set it with the adjusters. to stop that from happening you slot a BIG screw driver (whose diameter is about the same as the circle that is a sprocket tooth) into a tooth and wind the chain onto it.. so it pulls the rear wheel tight up against the adjusters.. so when you tighten up the nut it cannot twist out.

You can try giving it a real good clean with kero and a toothbruth, and try working the frozen link back and forth to loosen it up (bringing the wheel forward in the adjusters will probably make this easier).
Otherwise, you pretty much have to either accept that it's on the way out, or replace it.
