Thread: Bike lawyer required

    Yep its that time again when they want me to do an appearance up in York/Northam Court house for a fun filled morning of ridicule and anal abuse. I will be needing a decent lawyer out there to plead my sorry case , I was going to fight it but have opted for the full on absolute shameless grovel ploy . Pinged at 166 in a 110 from an oncoming unmarked car. Was tail end of a group of 4 bikes and somehow they pinged me.

    Im actually booked in for 9am the day I fly back to work ay 1205 , does anyone know if these things run on , as i'll have to ask for an earlier date in court if this is the case.

    Whats the go anyway for first offence reckless?

    Don&#39;t count on your case going ahead at 9.00, that is what time they tell you to be there, the magistrate wont start hearing things till about 10.00, sometimes a bit earlier and then it depends on how many cases are on that day as to when your case comes up, you could be there all day...

    If you need to be somewhere else that day, try and change it and allow a full day for the proceedings

    give the court a call, there may be an option of plead guilty and they can just rubber stamp it in your absence and advise you of the fine.

    i got done for 117 (keep in mind a 60 zone that was 40 due to not to be seen road works) over the bridge in york about 6 years ago, went to northam court and got 6 points and $450 fine thats it.

    i reckon they have pinged the last bike because that is the only bike they have an unconfused indisputable radar reading on, could be a tough one to beat. good luck with it

    Reckless Driving;
    (a) for a first offence, to a fine of 20 PU or to imprisonment for 9 months; and, in any event, the court convicting that person shall order that he be disqualified from holding or obtaining a driver&#39;s licence for a period of not less than 6 months;


    Penalty Units are $75 (i think) so thats $1500.

    Lucky they didnt just take your bike.
    The big penalty from that section is that it appears you lose your license for at least 6 months.

    Reckless = Careless + disregarding the danger you knew you&#39;d put others in.

    dont mean to make things more depressing for wackster, but isnt this all changed now because of hoon laws? i thought that hoon laws had re-defined reckless so speed in excess of 45kmh over a posted limit is automatically reckless?

    I think your only hope is to flee the country wackster, change names somewhere there is no extradition treaty with australia have your wife divorce you. get a new passport in the new name in your new country, come back to australia and marry your wife again under the new name and get automatic australian permanent residency.

    Yeah the wording is something like "reckless driving (which includes excessive speed)..." and then it goes on to say "anyone who drives at a speed greater than 155km/hr commits an offence under this section"

    yeah thanks guys , im still in two minds or 1 fighting it ....albeit a very weak case , or (2) teh shameless grovel fromm a small business owner family man , so out of character , have learnt lesson from the shame and humility and absolute stupiity of oneself...and any thing else you can throw in there .....or am i just weasting my time with lawyers and court appearances

    Given that you&#39;re pretty much fooked by the sounds of things without your licence, id be giving it a shot. Nothing ventured nothing gained. Worst case, 28 days without a licence then apply for extrordinary.

    i think you are mad if you dont consult a lawyer, and determine your best course of action based upon their advice. Not sure when the hearing is scheduled but you want to contact a lawyer soon as possible to give them time to prepare if it is determined you have a case that can be defended.

    If you just rock up at the court hearing, undefended and unprepared then don&#39;t be surprised if you get slammed with the maximum penalty or something close to.
