Ebay transaction... dispute or not?

Hey guys,

I'm after some opinions as to whether I should file dispute against a seller about a jacket I have ordered from the US that has not arrived yet.

Situation is as follows:
  • Purchased a motorcycle jacket via Buy it Now on the 10th Sept, paid by PayPal.
  • Recieved an email the following day from the seller saying payment recieved and confirming the address I wanted the item shipped to.
  • After not recieving the item or any further emails I sent the seller a message on the 19th Sept asking whether the item had been shipped.
  • I recieved no response to this.
  • Sent another email on the 24th Sept asking again if this item had been shipped
  • Recieved the following response:
"Hello there. I apologize for the delay in getting back to you. Your jacket has been shipped. I have been out of town the last couple weeks... I will track down your shipment today to see where it is. I will email you what I find out."
  • On the 2nd Oct I sent this message after still not recieving any info about the item:
Any news about where this item is? I have ordered from the US many times before and it has never taken this long to arrive, especially when I have paid for express post. Starting to get a little frustrated now as I would have ordered elsewhere had I known I would still be waiting.

If you could please follow up on this and let me know that would be appreciated.

  • Sent this to her on Oct 6th:
Hi Michelle.

Unfortunatly if I do not recieve an answer as to why this item has not arrived I will be filing a dispute against you. You have indicated that this item has been shipped so there should be no reason as to why I have not recieved it.

I expect a response within the next 48 hrs or i will take futher action
  • I then recieved this response on the 8th Oct
"I assure you that your jacket has been shipped. I am still trying to find the tracking number for you. Thank you for all your patience. I have been on the opposite side of the county for the last couple weeks, so I am trying to have my room mate find the tracking information for me. I promise.... it has been shipped. Not to worry!"

After having a look on ebay/paypal in order to get my money back I must file dispute within 45 days of the transaction occuring and then change the dispute to a claim within 20 days after. Do you think I should go for it or am I being impatient? I paid express post so should have recieved a tracking number for the package???

file the dispute, it has taken too long and at the current exchange rate you will have a win both ways.

If its creeping up to the date, I'd:

Email the vendor and explain that you've got no alternative but to file a dispute, due to paypals 48 day rule. He/She is a business person and wouldn't likely be screwing you over on purpose.

File the dispute. You can always "call the dogs back" when you receive the item. I'm sure if you explain the situation beforehand (eg: The item hasn't arrived, the person claims its been sent, 48 days nearly up so covering your ass but expecting the item soon), paypal will understand.

You only have 45 days to file a dispute, personaly I would file a dispute in a few days, you can allways cancel it if the goods do arrive.

File it.. I been in the same situation as this and had all the stories same as you seems they just try and drag it out till its pased the "use by date"

Yup, file it, soon. Many of the scammers on eBay will try to drag things out past the 45 days (I thought it was 30) because that after that there's not much you can do to hurt them.

A dispute doesn't necessarily mean either party hates the other and wants to pound them, it's just there is a discrepancy which needs to be resolved. By going through the dispute channels, it just means that Paypal have a record of communications between the two parties BEFORE (if) a claim is made for refund.

I've filed a dispute under similar circumstances. The vendor gave me a bad rep because I refused to give them a good rep when the goods finally did arrive (I paid for express door-to-door courier and it still took weeks from Melb.). So you may have to wear that.

ok, thanks guys...

once i had all the info in front of me (i.e. this thread) i decided to begin the dispute. now am awaiting her response.

I would be kicking myself if i hadnt checked that theres a time limit on when you can claim till.

On another note, what would be the point in NOT sending the item? Its a $300 jacket... hardly seems worth the effort/suspended ebay account etc.?

What rep does the seller have? any bad feedback at all?

Hope you get your jacket soon, I tend to trust people more than I should when it comes to these things, but you've done the right thing filing the dispute. Just try to keep it civil until you have no other option (which it sounds like you're doing)

This again happened to me, was a small amoutn, but think if they do it to a number of people it all adds up. In the end I was able to trace them down and contacted the police who got there fraud squad in volved as all fun ana games and this perso had in fact done a dirty on around 20 or so peoeple.....so just because uts a $300 deal for you wich does seem small, they could be doing the same thing to a lot of people.

File a dispute just before the deadline.

I once got led on by a seller over a $29.95 item and waited too long to file a dispute or even place bad feedback. Result - I never got the item and when I made an international call to the seller to put a rocket up him he just laughed.

If I'm ever in his part of the world, I am going to pay him a visit....

i'm in the same boat.

fucking idiots from america have taken more than a month and a bit to send me my pazzo's

gave me some bullshit excuse about hurrican ike, which is fair enough, but doesn't excuse their lack of communication or unanswered emails until i threatened them with paypal a week ago.

and now i STILL HAVEN'T gotten my pazzo's

i'm patient but this is fucking ridiculous.

so in answer to your question, yes file the dispute and leave negative feedback....in my case, negative & abusive feedback.

Once I waited 8 months for a cordura jacket. Long story short, 100 emails and 6 million excuses later (and yes he told me his father died blah blah after 7.5 months, at which point I had zero sympathy) he finally refunded my money.
Punchline: I got twice as much as I had paid for (go figure) and 4 weeks later I actually received the jacket as well.

I didn't think stores could sell Pazzos to us anymore without a certain importer having a cry to Pazzo?

yeah. i bought them from motomummy first then got told they don't sell to aus anymore so went to ebay. bad move.
