Getting out of a phone contract (3)

Im on a $29 contract with 3, Got its a 24 month contract with about 12 months to go. Contract is linked to a handset at $10 a month, making total payments $39 a month.

The contracts that are out now have changed and I feel I am no longer getting value for money. $120 credit + 100mins of free calls to 3 just isnt cutting it and ive blown my cap 2 months running.

Optus does a $19 cap which gives you $50 of credit a month. If you add on the unlimited sms pack to that (+$15) that makes a $34 cap with unlimited SMS to any GMS mobile plus $50 of calls for $34 a month. I only spend about $20 a month on calls the rest is all SMS so that plan is perfect for me. I can SMS to my little hearts content with no worries about big bills at the end of the month.

I want to know how much I should expect to get out of the cap with three. I dont want to go in with no prior info and have them tell me some BS that isnt right. I understand that I will have to pay somthing as the phone is still getting paid off but can I get out of it while still paying less than $468 left remaining on the plan?

Also will it be cheaper to go to Three or can I go to optus and get it cheaper that way?

You'll probably be paying several hundred dollars, maybe 700 or 800. Your best option would be to upgrade to a different cap on 3.

a contract is a contract, and can only be negated if both parties agree or one person breaches the contract. since what you want to do would be effectively a breach, the phone company can, and most likely WILL, pursue you for the total value of the remainder of the contract plus a dishonour fee, if it's written into it. so you're looking at 12x$39 + dishonour fee (usually a couple to a few hundred dollars).

about $320... but talk to them first because you might be able to go across to there new cap. I am on a $69 cap with them and it gives me $650 worth of calls and text and 600- min free to 3

hmm doubt it will be the full amount because they are not providing you with services, they cannot charge you a penalty because it is not enforceable, they can however charge you a sum that is equal to a reasonable measure of damages they will suffer by your early termination - that is your minimum repayments for remainder of term less the cost of them providing you with your cap.....

Normally they set a figure at the beginning that reduces on a pro-rata amount, so it may be $500 at month 1, $250 at month 12 etc.

I would upgrade to a bigger cap but it seems silly. Im currently paying $29 for the plan and for an extra $5 I could be getting more than I can use by way of unlimited sms. If 3 had a sms pack like optus does then I would be happy get that instead.

I guess ill have to try find the paperwork. Is there anyone that works at 3 that would be able to point me in the right direction of where to look?

Just checked it out I have 11 months left of the 24 month contract if that helps anyone.

Just call them and ask, they will tell you straight out.
I think i did overestimate there, but it'll be at lease a few hundred. At the most, it will cost you 39x12= $468, but itll probably be less.

check your contract - I'm pretty sure that you just have to pay a contract termination fee. I may be completely wrong, this is what I did with Telstra years and years ago. After 6 months I cancelled the contract and only had to pay $125.

Which is annoying coz about a month after I got the contract my phone became free on the $29 cap. Ill go in tomorrow and update you all on how things go.

u should be able to change to the newer 3 $29/contracts that get you $150 without any hassle.

also, with 3 you can move up to a higher cap plans without any penalty.

Biggest bunch of thieving cunts I have ever met in my life.
Do nothing to help the customer at all, it's all about them grabbing money and not informing you of anything.
I'll never recommend them to anyone, and after 3 years with them, will never ever use them again for anything.

I used to love three, i was a 'first on three' customer, signed up within a month of them starting up, they were the first ever cap. For seven years I was a three 'business' customer, recently i did a name change and ownership switch, now, they dont recognise my seven years of loyal business, and treat me like shit.
Fuck three.

If you upgrade to a bigger cap does the 24 months start again? Also will my phone then become free or will I continue to have to pay the $10 a month? Staying on 3 would be good coz the free calls to my parents and most of my friends is nice (even if I dont use them much). But the Optus cap works out alot cheaper.

I dont want to get raped. I just want a contract that suits me without being too expensive... I send alot of sms so the optus unlimited sms deal appeals to me. I need to do somthing tho coz with keeping on blowing my cap things are getting expensive.
