There is no expiry on a periodic tenancy agreement.
Did you terminate for non-payment of rent though? It would makes sense that the Court would want to see evidence of non-payment of rent in that instance, but not in XIII's case where he is terminating without specifying a ground (i.e. by a 60 day notice of termination).
Yeah I understand that, but I am presuming XIII had a fixed term tenancy with the tenant initially and that it ended with XIII allowing the tenant to remain in the premises (which is usually the case).

Well folks just an update court was yesterday and the magistrate ruled in my favor teants have been given 14 days notice it seems it is just a case of them not being able to find somewhere the plead hardship i hope they find somewhere there was a real estate agent at the court who said she will try her hardest to find them a place so lets wait and see

Well good news keys get returned lunch time tomorrow final inspection thursday should be moving into the place sat have know idea where the tenants are going hope they are not living out of a car
So inspection went well place is trashed carpets stuffed oven door missing benchtop burnt and warped aeril on back shed bloody dogs so much for the poor i cant find anywere family least im insured

just wondering... if the place is trashed by the tenant (either willfully or accidentally) and is covered by Landlord Insurance...
Does the insurer have the right to chase after the tenant to recover the costs or repair? similar to a car insurance claim?

On the bright side im getting a new oven and kitchen bench useless bastards could of burt the place down would of been better im still trying to figure out what you do with an oven door . i think the realestate has blacklisted them got heaps of photos with the real estate chick never thought of the cops
