    Advice on hit & run accident

    About 6 weeks ago my daughter was driving her car, stationary at an intersection behind another car. The car in front reverse lights came on so she beeped her horn but it reversed into her.

    She and her friend got out to talk to the driver but he took off.

    They have the rego number and she has made a police report.

    (As usual, this info is all 3rd hand and extracted from my daughter and ex wife with great difficulty)

    I lent her my spare car to use while she got hers fixed.

    Now I ask what is happening... my ex had somehow let the insurance lapse on Nikkis car... police have told her they won't give details of the driver... her car is strill sitting in their garage.

    I got pissed off and took my car back to force them to do something about it.

    What action should they be taking?> Surely the Police should be following up the H&R and his insurance should be paying?

    they can apply for the information under freedom of information act, will take a while. how long had the insurance been lapsed some companies give you a months grace, they should at least get a quote and find out what the damage is going to be. If the other party is uninsured too then they will have to get it fixed and then take them to court and hope for a win.
    Dont see a quick solution how bad is your daughters car?

    So there is enough damage that it is unroadworthy from someone reversing into it. I'm sure it is possible but are you absolutely certain it's not a case of daughter ran into the back of someone and doesn't want to tell dad she fucked up???

    I could be wrong but I was under the impression that if you have a rego number you can pay to find the owners details. Get a copy of the police report and go around there and demand the money or take them to court.

    Might as well pick people's brains. Yesterday was driving the missus' car. Give way sign, car in front turning left as i was. Look right, no cars, start to roll look forward, car hasn't moved & stamp on brakes. I was positive i didn't touch him but he was positive i did..

    Gavr him my name & # and took 20 photos of his car in case he decided to reverse into a wall. New subaru outback with a towball. Couldn't even see a scratch on it, let alone our car's plate.
    He said nothing should come of it, didn't take our plate details.

    Any experience to add? What i should've done (post accident, smartasses ) and what i should do now?

    I went to the copshop myself today but they weren't much help... my daughter is 19 so an "adult" yeah right...

    After being given the "nothing we can do" and "we're not interested in insurance" bullshit that no doubt my stupid ex was given, I continued to press for advice... they checked that a report had in fact been lodged, and that they will decide "if it is the police's interests to prosecute" WTF?? they THEN told me that she can get the other driver's info, as you said, through "freedom of information".

    So, if she pursues this, and apologises for what she called me, she can use my car again...

    Just been informed by the ex that the other car was full of *&^%s... FFS!! so now I'll assume it was stolen, and either way won't have been insured, so looks like she is without a car, even though she is a full time uni student and works as much as she can.

    Meanwhile my ex is battling with the insurance co as she can show that the premium WAS in fact deducted from her account, but they are dragging it out, and she is too dumb to keep on their case about it... and I get drip fed info

    It's going to be hard to prove that your daughter didn't hit his car, rather than he reversed into her.

    It's gonna be their word against the other driver's unless there's independent witnesses. It is unfair, but if you do get in contact with the other driver's insurance company they're gonna argue that point until you just give up. Not much you can do mate.

    if the premium was deducted and they still dont want to co-operate they need to call the insurance ombudsman and make a complaint. things tend to move once there involved but as we know insurance companies are in the busness of collecting premiums not paying claims.

    Also, if the insurance ombudsman is anything like the financial services one, the company will lose $1000 to resolve the dispute, even if they 'win'. Can be an incentive for them to accept and resolve the complaint...

    Sorry to hear, sounds like it will have to be a pay for it yourself (or your ex) or hopefully the insurance will coff up.

    I had a Landcruiser reverse into me in a parking area, he had discovered a better spot to park instead of waiting for the one he was, chucks it into reverse without looking in his mirrors and starts screaming backwards, I was a good 2 metres behind him, trying to get the car in reverse and had my hand on the horn the whole time. Stupid prick, stove my bonnet in and pushed the bumper backwards.

    Luckily someone was walking past into the shops and saw it all, the cruiser driver tried blaming me for parking too close that he couldn't see me !!!

    According to the insurance company it would have been an at fault claim without the witness!!

    have to ask the cops how it works, i expect they cannot give out information until they can put some ticks in some boxes. they cannot give information from computer database (like who belongs to what plate and where do they live) to the public but 6 weeks is too long. the car involved could have been repaired in that time or something else could have happened to it.

    maybe thats what cops mean when they blab on about getting out and doing some policing and doing less paperwork. imho be big of you to forget about the insurance lapse since there is nothing that can be done about it now and talk to ex about repairing the car for xmas.

    If you find out who the other perrson involved was and they havent put in a police report about 2 girls running in to the back of him, then surely this must indicate that he may have been at fault. Any normal person would have reported it to the police so this may work in your favour.

    I had some P plater bint drive into the back of my towball three times in stop start traffic.
    Since there was no damage to my car at all and I didn't get her numberplate (she drove down the emergency lane after the third collision because i told her to pull over) I didn't bother filing a report.
    There would have been obvious damage to her car.

    There may have been little or no damage to his car.

    The whole story sounds a tad fishy. How much damage was done to her car?

    The police have a duty under the Road Traffic Act to provide all involved persons with sufficient details to enable them to report the crash to insurance. This means they should give your daughter the owner/drivers details and they should give your daughters details to the other party. All parties involve in a crash are required to exchange details( veg rego name and contact details) even though there is most likely no charges from this crash your loving ex and your very polite and understanding daughter ;-) can take. Ivil action if required. If the police are not forthcoming with the details then by all means complete an FOI and they have a requirement to deal with it. I would advise you to ring 'crash records office' at the old traffic office on plain st and Wellington st.

    From my own personal experience with a hit and run (over)....the police are as much use as a chocolate teapot in these cases.
    If there are no witnesses, then in their own words to me "its their word against yours". The fact that I had just been run over by the douche bag and had grazes and cuts didnt seem to matter to the police. I had pictures from my phone of his car, the rego and make/model of the car as well (he had reversed into my car and when challenged, he ran me over and drove off)
    They didnt even go round his place to check his car for damage....they wonder why people have no respect sometimes
    To be perfectly honest, and its not what you want to hear, but get the car fixed (get parts etc from breakers, mates etc all chip in and help out)..and then move on.
    Live in the hope that Karma will come back round and bite the lowlife in the ass one day soon.
