    Long service leave

    I was speaking to my future brother in law the other day about work issues and he told me that Pro rata long service leave has been changed to 7 years from 10 years.
    Can anyobe tell me if this is correct and or when it came into effect and what you need to qualify and how many weeks are you entitled to or can you put me in contact with someone who can explain it to me.
    1 started work in 2000 and if this 7 year rule is correct it may have a bigger influence on my future.

    I think it depends on what award you're covered under. I know that (as a heavy diesel fitter), pro-rata has always been 10 years for myself. There was a campaign to change this to seven (maybe to bring it in line with other awards - I'm not sure) back in the mid to late 80's, but it wasn't succesful. Given this day & age though, there are very few people who survive 10 years with one company, so I think it's a bit of a wrought.

    I might be wrong (won't be the first time) but my take on it is:

    Full entitlement is achieved at 10 years of complete service (i.e if you have any period of Leave Without Pay - if your employer approves such an entitlement).

    At 7 years of service (with the same qualifying proviso's as the 10 year mark), you achieve a pro-rate entitlement of the 10 year allocation. Follow?

    So...at 7 years (and you resign)...you can have the LSL entitlement, but you won't be entitled to the full amount, only the pro-rata amount (i.e 3/5 of 5/8 of fuck all of 3 months).

    99% steve, you cant take it at 7 yrs as such, but if you LEAVE then you are entitled to it

    If you think of it like , If i click over 7 yrs then the amount is then locked in the bank for me, if i get to 6yrs 11 months and leave then you havent got to 7 years and it isnt locked in

    In saying all of that, an employer, upon mutual agreement CAN allow an employee to take LSL after 7 yrs, coz they will have to pay it anyway when they leave, it is very rare this actually happens though.

    If I were an employer i would rather allow someone to take a portion after 7 years, may as well pay them at todays pay rate rather than tommorrows.

    SD if you are thinking of moving on AND LSL is a concern try and confirm what your entitlement is before you leave

    Just so you dont quit, count on the coin and then MAYBE find out you are still covered by 10/15 under a federal LSL provision

    even though its come down to 10 years you are not given 13 weeks like at 15 years. 10 years only gives you the same entitlement as if you were getting it at 15 anyway.

    What I mean by that is after 10 years on a 15 year lsl you had acrued I think 10 weeks or something like that and it accrues exactly the same so you are only getting 10 weeks LSL but just allowed to take it sooner so don't think you are getting more leave. Its basically only allowed us to take it sooner.

    Cheers for the concern but the long service is really only a bonus if i get it as i wasnt counting on it anyway.

    Where i work.. you can get pro rata after 5yrs.. full after 10yrs.
