    Personal injury lawyer recommendations?

    Hey everyone,
    I was injured in a motorbike accident when a car turned out in front of me back in December.

    Took some pretty significant injuries and the other driver is clearly at fault. I've been dealing with the Insurance Commision of WA, they've been sorting my medical bills and they will be the ones to handle my personal injury claim (I don't actually have deal with the other driver as far as I've been told)

    Can anyone recommend me a personal injury lawyer that they know / have dealt with before?

    I've been given general advice against lawyers who advertise (Stephen Browne etc) as they charge more

    Has anyone else here been in similar situations? Would appreciate any recommendations / general info like who to talk to, what to expect, how long it actually takes to sort out etc?

    im going thru stephen browne lawyers at the moment for a crash back in feb

    things arent moving that fast so unfortunatley i cant give much in the way of details.

    This guy helped me and was absolutely awesome in the way he handled everything.
    Depends on how bad your accident was to how long the claim will take to get finalized.

    If you have been dealing with ICWA up untill now as soon as you hire a lawyer you will not be able to talk to them. I would recommend you get a lawyer now and don't wait. I have heard of some very bad things done by ICWA to people who thought they could'nt afford a lawyer. You will find that any good lawyer who thinks you have a case won't make you pay anything at all, they will take it from the final amount at the end. Make sure you find out what they take before you tell them to take your case on.

    i deal with these guys a lot - my advice is go to a reputable firm and advise them that you will NOT be using their services on a contingency basis [ie %] but on a hourly rate - you will have much better control over the outcome. the ones mentioned above may not fit into that group. Marras is correct in that as soon as you have legal representation it is required that all correspondence goes via them. you can not deal direct with INCWA. the outcome depends on the level of documentation of injuries and loss of earning capacity now and longterm. the more precise this can be estimated and the more explicit the medical reports the less that can be argued away. when you come to negotiation, real values based on proper assessment will carry. guesses based on emotion fail.

    I'm going through this at the moment, almost been 2 years now since the accident and there is only one lawyer that I can reccomend. David Bayly from Bradley Bayly Legal. Please, at least go talk to him. Seriously, I have total confidence in him and through a lot of the negotiations, he has surpassed even his own expectations. Please, please, PLEASE at least go talk to him. I can't reccomend anyone more highly. He is just fucking amazing. Go talk to him.

    Friedman Laurie Singh and D'Angelo, if you don't reach the minimum compensation bracket you don't pay a cent to the lawyers, as for lawyers fees should you reach the minimum bracket you're out of pocket expense is $1500, insurance commission pays for a large portion of lawyers fees. I'm currently going through a claim after an accident in November last year, according to my lawyer average settlement is minimum 18 months.

    Insurance commission doens't pay a cent towards your legal fees? If you've been told otherwise, you really should talk to the ACCC
    They've also got protocol which is to keep it to a minimum of 2 years for accidents that have lasting injuries

    thats what was said, that my out of pocket expense after settlement should I reach the minimum bracket is $1500 and the remaining amount was covered by the insurance commission, I'm fairly sure thats what she said. could be wrong. either way I know my out of pocket expense after is $1500 should I reach a settlement, if not it's nothing.

    Yeah, the insurance commission doesn't give you a dime towards lawyers fee's, whatever they cost you will come out of your own pocket or the agreed settlement at the end, they don't add extra onto it to cover the lawyers

    Yes that someone is you.

    ICWA pay out for pain and suffering, ongoing treatment, loss of projected income etc, by using a good lawyer you may get a larger payment than if you collated and presented the data yourself but once the legal fees and medical costs come out of it there won't be much left. More than if you represented yourself in most cases but it's not the jackpot some think they're entitled to.

    check the paperwork very very carefully. your legal fee if you pass the bracket, is most likely $1500, that is, if $1500 is more than like 20-25% of what your settlement is. If the settlement is more, more than likely, you're going to be looking out at forking over 25% or so of what you get. then on top of that, if there have been any medical reports you've had to have done, they're going to be coming out of your pocket. And they aint cheap. The osteo surgeon report that I had to have done ran $5,500..... That was one of the around 9 reports I had to have done...

    Woody, I hate to rain on your parade but the insurance commission does pay most of your legal fees ... it does when you use Kakulas Legal.
